This statement provides information about how Distinction Realty Pty Ltd (“we”, “us”) handles personal information
that is provided by a person (“you”), to the extent that the Privacy Act 1988 (Cth) applies to us.
Open Home Attendance
It is a condition of entry that, before attending an Open Home, you provide us with your name, telephone number,
email address, and any other contact details we request.
If this information is not provided, you will be unable to enter the Open Home, and we may be unable to determine
or address your interest in the property effectively or at all.
We may collect personal information you provide in connection with an Open Home for the following purposes:
- To ensure the security of the Open Home and the safety of all attendees.
- To contact you after the Open Home to determine or otherwise address your interest in the property.
- To contact you after the Open Home to inform you of other properties we have listed for sale or rent.
- To provide information regarding the property market around your area or in relation to an Open Home you attended
or expressed interest in. - To provide feedback to our client regarding the level of interest generated in an Open Home.
Buying, Selling, or Renting a Property
We may collect personal information you provide in connection with a property sale agreement or rental agreement
(collectively, a “Property Agreement”), or from other sources, for purposes including:
- Identifying and verifying your identity and the property.
- Acting on your behalf in accordance with the Property Agreement.
- Advertising, promoting, or marketing the property for sale or rent.
- Negotiating any prospective sale or rental of the property.
- Liaising and exchanging information with you, the purchaser or tenant, prospective purchasers or tenants, and their
legal or other advisers in connection with a sale or rental. - Complying with the Property Agreement, applicable law, and any dispute resolution processes.
- Managing, serving, and signing (or arranging signing of) the Property Agreement, and assisting with the exchange
of the agreement and preparation of required statements of account. - Contacting and liaising with third parties (including goods and services providers and insurers) and providing them
with your personal information to facilitate the services provided.
If you do not provide the requested personal information, we may be unable to act on your behalf effectively or at all.
Disclosure of Personal Information
We may disclose your personal information for the purposes outlined above to:
- Actual or prospective purchasers or tenants
- Our legal and professional advisers
- Existing and potential clients
- Advertising and media organisations
- Property data service providers and valuers
- Parties engaged to evaluate the property
- Owners’ corporations
- Financial institutions
- Real estate professional bodies (which may assist us technically or otherwise)
- Other third parties (including goods and services providers and insurers)
- Government agencies, courts, regulatory bodies, and law enforcement agencies
We may also use your personal information for marketing and research purposes.
Overseas Disclosure
We may use third-party suppliers and service providers located outside Australia and may disclose your personal
information to them to obtain their services. We seek to ensure that these overseas recipients comply with privacy
obligations relating to your personal information.
